1. About these terms
These Terms of Service form an agreement between you and Sunrm Pilates Pty Ltd. By making a booking, purchasing a class pack or membership, using a gift voucher or accessing our website at https://sunrmpilatestec.online, you agree to be bound by these terms. If you do not agree with any part of these terms, please do not use our services or website.
2. Who we are
Sunrm Pilates Pty Ltd (Australian Business Number ABN 90 702 565 884) is a pilates and movement studio based in Melbourne VIC. We provide group reformer and mat classes, private and duet sessions, movement assessments, workshops, memberships, class packs and related studio services. 3. Our services
Details of our current class types, memberships and studio services are set out on our Services page. Class availability, timetables, instructors and class formats may change from time to time. We do not guarantee that any particular class, instructor or time slot will be available at any given time, although we will always work with you to find a suitable alternative.
Information on this website is general in nature and is not medical advice, and it does not take into account your individual health circumstances.
4. Eligibility and health and safety
Participants must be 16 years of age or older, unless the class is specifically advertised as suitable for younger participants and a parent or guardian has provided written consent. By booking a class, you confirm that:
- you are in suitable physical health to participate in pilates and movement exercise;
- you will disclose any relevant injuries, medical conditions, recent surgery or pregnancy before your session, and you will follow any reasonable direction from our instructors;
- you understand that pilates and movement classes involve physical exertion and carry an inherent risk of injury, and you participate voluntarily and at your own risk;
- you will seek appropriate medical advice before starting any new exercise program where you have any doubt about your ability to participate safely.
Our instructors are qualified movement and pilates professionals but are not medical practitioners, physiotherapists or other registered health practitioners, and our classes do not constitute clinical treatment. Nothing in this clause excludes or limits any liability that we cannot exclude or limit under Australian law.
5. Bookings and attendance
Bookings can be made through our website, by email, or in person at the studio. Your place in a class is confirmed only once payment or a valid class credit has been received. We ask that you arrive at least 10 minutes before the scheduled start time so you can settle in safely. If you arrive significantly late, we may need to refuse entry for safety reasons, and the session may be forfeited. If a class is full, you may join a waitlist and we will notify you if a place becomes available.
6. Cancellations, no-shows and changes by us
Group classes may be cancelled or rescheduled by you up to 12 hours before the scheduled start time without charge, using our booking system or by email. Cancellations inside the 12-hour window and non-attendance will generally result in the session being deducted from your class pack or a late-cancellation fee applying to direct debit memberships.
Private and duet sessions may require a longer cancellation window, which will be confirmed at the time of booking.
If we cancel or reschedule a class (for example, due to instructor illness, studio maintenance or insufficient bookings), you will be offered a make-up session, a credit or a refund for the affected session, at your choice of credit or refund unless a different arrangement is agreed with you.
7. Memberships, class packs and payment
Prices are quoted in Australian dollars and include GST where applicable. Memberships are billed on a recurring basis through a secure third-party direct debit provider, and class packs are paid in full at the time of purchase. By setting up a direct debit, you also accept the payment provider's terms, which will be provided to you before your first billing cycle.
Class packs have an expiry date, which is displayed at the time of purchase. Memberships may be paused for medical or travel reasons on request, in line with our membership policy. Failed payments may result in services being suspended until the account is brought up to date. We may change our prices or membership terms from time to time, and we will give you reasonable written notice (at least 14 days) before any change that affects an ongoing membership takes effect.
You may cancel an ongoing membership at any time in accordance with our membership policy, which will be provided to you when you sign up. Where a notice period applies, billing will continue until the end of that notice period. We do not charge undisclosed exit fees.
8. Gift vouchers
Gift vouchers are valid for at least 12 months from the date of purchase, in line with the gift card rules under the Australian Consumer Law, unless a longer validity period is stated at the time of purchase. Vouchers are redeemable for the services stated on the voucher, are not redeemable for cash, and may be transferred to another person unless otherwise stated.
9. Australian Consumer Law guarantees
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred on you by the Australian Consumer Law (set out in Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or any other law that cannot be excluded, restricted or modified.
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For a major failure with our services, you are entitled to cancel your agreement with us and receive a refund for the unused portion of your membership or class pack, or compensation for the reduced value of the services. You are also entitled to have the services supplied again if they fail to be of acceptable quality and the failure does not amount to a major failure.
If you believe our services have not met a consumer guarantee, please contact us at [email protected] and we will work with you to provide an appropriate remedy in accordance with the Australian Consumer Law.
10. Refunds and credits
Except where the Australian Consumer Law requires otherwise (including under clause 9), class packs, memberships and vouchers are non-refundable once commenced, but may be credited or transferred in appropriate circumstances at our discretion. Refunds, where payable, will be processed to the original payment method within a reasonable time.
11. Limitation of liability
To the fullest extent permitted by law, our liability to you in connection with these terms and our services is limited, at our option, to supplying the services again or paying the cost of having the services supplied again. We are not liable for indirect, incidental or consequential loss, including loss of profit, opportunity or enjoyment, except where such liability cannot be excluded by law.
Nothing in this clause limits or excludes your rights under the consumer guarantees described in clause 9, or any other liability that cannot lawfully be excluded.
12. Studio conduct and personal property
While in the studio, you agree to follow all reasonable instructions from our staff, observe studio safety rules (including the use of grip socks on reformers where required), and treat our team and other participants with courtesy. We may suspend or cancel your bookings or membership if your behaviour endangers the safety of others or breaches these terms repeatedly.
Personal property brought into the studio is at your own risk. We provide secure storage where practical, but we are not responsible for loss or damage to personal items except where caused by our negligence.
13. Intellectual property and website use
All content on this website, including class programming, descriptions, imagery and branding, is owned by or licensed to Sunrm Pilates Pty Ltd. You may view and print content for personal, non-commercial use only. You must not reproduce, adapt or distribute our content for commercial purposes without our written consent.
You must not use our website in a way that breaches any law, infringes anyone's rights or interferes with the website's normal operation.
14. Third-party platforms
Our bookings, payments and direct debit services are facilitated by third-party providers. Those providers have their own terms and privacy policies, which we encourage you to read. We are not responsible for the acts or omissions of third-party providers, except where the law requires otherwise.
15. Privacy
We handle personal information in accordance with the Privacy Act 1988 (Cth) and our Privacy Policy. By using our services, you consent to the collection, use and disclosure of your information as described in that policy.
16. Changes to these terms
We may vary these terms from time to time. The current version will always be published on this page with an updated "last updated" date. For ongoing memberships, material changes will be emailed to you at least 14 days before they take effect. If you continue to use our services after changes take effect, you are taken to have accepted the updated terms. If you do not agree with a change, you may cancel your membership in accordance with clause 7.
17. Suspension and termination
You may end a casual booking in line with clause 6, or an ongoing membership in line with clause 7. We may suspend or terminate your access to services immediately if you fail to pay amounts owing, seriously breach these terms, or engage in conduct that endangers the safety of our team or other participants. Where we terminate for reasons other than your breach, you will be refunded the unused portion of any prepaid fees.
18. Governing law and dispute resolution
These terms are governed by the laws of Victoria, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of Victoria. If you have a complaint or dispute, please contact us first at [email protected]. We will acknowledge your message within 2 business days and aim to resolve matters promptly and in good faith. You may also have rights to make a complaint to consumer protection bodies such as Consumer Affairs Victoria.
